Important information for consumers
In our publicly accessible auctions, consumers do not have a right of withdrawal, even when the contract is concluded solely by means of distance selling; § 312g para. 2 no. 10 BGB. The supplementary provisions on consumer goods sales do not apply either. This particularly concerns the warranty for defects, sales involving shipment, as well as other special provisions (cf. §§ 474 et seq. BGB).
The auction is voluntary and public, conducted in the name and on behalf of the consignors, who remain unnamed during the auction. The auction house acts as intermediary. It is entitled, even after the auction, to refuse disclosure of the consignor’s identity, provided that it simultaneously assumes joint and several liability for any obligations of the seller.
The objects offered in the auction and in post-auction sale are without exception second-hand and are sold in the condition in which they are at the time of the knockdown or post-auction sale. No liability is assumed for visible or hidden defects. Prospective buyers are obliged to examine the items on offer during the preview and to inspect any existing expert reports, for which no liability is accepted. Interested buyers may also, at their own expense, obtain expert reports on the auction items, provided this does not endanger the auction date. Written and oral descriptions of objects in the auction, post-auction sale, and in both printed and digital auction catalogues are made to the best of knowledge and belief and serve exclusively for information. However, they do not constitute warranted characteristics and are not guaranteed by the auction house.
The liability of the auction house as intermediary is excluded unless its owners, representatives, or agents are guilty of intent or gross negligence. This limitation of liability does not apply to damages arising from injury to life, body, or health caused by negligent or intentional breach of duty by a representative or agent, nor to breaches of essential contractual obligations (breaches which could endanger the fulfilment of the contractual purpose) and damages caused by delay.
In the auction, the knockdown is made to the highest bidder after being called three times. There is no entitlement to the award of a knockdown. The bidding usually starts at the reserve price stated in the catalogue. Bids are made in euros. In general, increments are 10%. If several persons place the same bid at the same time and the auctioneer’s request for a higher bid remains unsuccessful, the auctioneer shall decide. If a timely bid has mistakenly been overlooked or if there is doubt regarding the knockdown, the auctioneer is entitled to revoke the knockdown and reoffer the item.
To receive a bidding number, proof of identity by presenting an identity card is required. The auction house reserves the right to request a credit card number or a cash deposit as security. In accordance with the Money Laundering Act, it is obliged to identify buyers or prospective buyers for the execution of the order and to document and retain this information. The duty of cooperation particularly includes the presentation of valid identification documents (identity card, passport, or substitute document). The auction house is entitled to copy or scan these documents, observing data protection, and retain them. For legal entities or partnerships, a commercial or cooperative register excerpt must be presented. Buyers or prospective buyers assure the accuracy of their information.
After the knockdown, the buyer is obliged to accept the auctioned object and to pay the purchase price. In case of doubt, the auction record determines the amount of the knockdown. The knockdown may be subject to reservation, particularly if the reserve has not been met (underbids). In this case, the bidder remains bound to his bid for three weeks. Any packaging, shipping, and insurance costs incurred will be charged separately. Shipping is exclusively at the buyer’s cost and risk. The shipping order must be placed in writing. Goods will only be insured at the buyer’s explicit request. Upon knockdown or conclusion of post-auction sale, the risk of total or partial loss or damage to the auctioned or purchased objects passes to the buyer, who acquires ownership only after full payment of the total invoice amount. The auction house accepts no liability for the goods after knockdown or post-auction sale, except in cases of intent or gross negligence.
The purchase price is due upon knockdown and must be paid to the auction house within 10 days. Deferrals are not permitted. The purchase price consists of the hammer price, a 20% buyer’s premium, and VAT at 19% on the premium. Since VAT is levied only on the commission, i.e. a service, a refund in the case of export by private buyers (EU and non-EU countries) is not possible. For live bidding via platforms (e.g. lot-tissimo, Invaluable, drouot, live auctioneers, etc.), the respective platform fee (usually 5% of the hammer price plus VAT) is additionally payable and shown separately. In the event of payment default, the auction house reserves the right to take legal action after two reminders. Invoices issued during or immediately after the auction are subject to review and possible correction, errors excepted. Delivery of purchased items requires prior payment of the purchase price for all objects acquired. Ownership passes only upon full payment and delivery.
Identical written bids will be considered in the order in which they are received. Without exception, the stated catalogue number is decisive. The bids are regarded as maximum bids for the knockdown. The premium is charged additionally. Orders from unknown customers can only be executed if they register before the start of the auction and/or provide sufficient security; otherwise, their bids may not be carried out. Telephone bidders will be called before the lot number they wish to bid on, provided a written request has been submitted 24 hours before the auction begins. The reserve price is deemed bid upon submission of the telephone request – even if the bidder cannot be reached at the time of the call. The auction house accepts no responsibility for establishing or maintaining a telephone connection. The provisions on distance contracts under §§ 355 BGB do not apply, since § 312g (2) BGB applies (see note before section 1). The auction house reserves the right to exclude persons from the auction without stating reasons.
Place of performance is the seat of the auction house (Hamburg). If the buyer is a merchant or has no general place of jurisdiction in Germany or another EU member state, the exclusive place of jurisdiction for all disputes is the seat of the auction house. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Items from the period of the Third Reich are released only for purposes of civic enlightenment, defence against unconstitutional endeavours, art, science, research, or teaching, reporting on current events or history, or for other similar legitimate purposes (§§ 86a, 86 StGB). The auctioneer offers these items only under this condition. By submitting a bid, this is expressly acknowledged.
Additional or deviating agreements must be made in writing. Should any of the above provisions be invalid or become invalid, it shall be replaced by a provision corresponding to the meaning and especially the economic purpose of the invalid provision.
