By registering and bidding, you agree to these Terms.

 

Definitions

“Bidder” means any person who registers to bid or places a bid at auction, whether in person, online, by telephone, or otherwise.

“Buyer” means the Bidder whose bid is accepted at the fall of the hammer.

 

1. Auctioneer Status

The Auctioneer acts only as agent for the Vendor. The contract of sale is between the Buyer and the Vendor. The Auctioneer shall have no liability for any default by the Buyer or the Vendor and shall not be responsible for payment to the Vendor until cleared funds are received from the Buyer.

The Vendor shall indemnify the Auctioneer against any claims arising in connection with any lot.

 

2. Bidding

The highest bid at the fall of the hammer is the successful bid.

All bids are final, irrevocable, and legally binding.

The Vendor reserves the right to bid personally or through an agent.

The Auctioneer may refuse bids, withdraw lots, divide or combine lots, regulate bidding, or resolve disputes at its absolute discretion, including re-offering any lot.

Lots may be sold in any order.

Bids must be made in increments determined by the Auctioneer.

The Auctioneer reserves the right to refuse admission to or participation in any auction.

 

3. Payment, Collection & Risk

Full payment must be made by the Wednesday following the sale, being the first Wednesday immediately following the auction date, unless agreed otherwise in writing.

Time shall be of the essence in respect of all payment and collection obligations.

Lots remain at the Vendor’s risk until the fall of the hammer and thereafter at the Buyer’s risk.

Title shall not pass until all sums due are paid in full.

 

If the Buyer fails to pay, the Auctioneer may, without prejudice to any other rights, cancel the sale, re-offer the lot, and recover all losses, costs, fees, and shortfall as a debt from the Buyer.

The Buyer shall not be entitled to withhold or set off any payment due.

No communication or dispute shall extend payment or collection deadlines unless expressly agreed in writing by the Auctioneer.

 

Deposits & Card Authorisation

By registering, the Bidder irrevocably authorises the Auctioneer to charge their registered payment card for all amounts due, including purchases, deposits, fees, costs, losses, and resale shortfall, including where the Buyer fails to complete payment within the required timeframe.

The Auctioneer reserves the right to require a registration deposit prior to bidding.

The Auctioneer may charge such deposits at any time before or after the sale.

A post-sale deposit may be taken from the registered payment card following a successful bid.

 

If the Buyer fails to complete payment:

all deposits shall be forfeited absolutely; and

the Auctioneer may charge the registered card for all outstanding sums and losses.

 

Deposits are non-refundable in all circumstances of Buyer default and may be applied against any sums owed.

 

4. Fees

A Buyer’s Premium is payable on all lots purchased, in addition to the hammer price.

 

In-room, telephone, and bidding via the Auctioneer’s website or Easy Live Auction:

A Buyer’s Premium of 32.5% (including VAT) applies for invoices settled by the Wednesday following the sale (minimum £2.40 per lot).

A Buyer’s Premium of 42.5% (including VAT) applies where payment is made after this date.

 

Bidding via The Saleroom:

A Buyer’s Premium of 38.44% (including VAT) applies for invoices settled by the Wednesday following the sale (minimum £2.40 per lot).

A Buyer’s Premium of 48.44% (including VAT) applies where payment is made after this date.

 

Where a Buyer fails to pay by the Wednesday following the sale, the higher Buyer’s Premium rate will apply to all future purchases, and a higher registration deposit will be required.

 

Late payment will also result in an administration fee of £12 (including VAT).

 

Shipping is at the Buyer’s request and risk. The Auctioneer accepts no liability for shipping or delivery. All lots must be removed at the Buyer’s expense.

 

The Auctioneer does not accept payment by cheque. Accepted payment methods are debit card, cash, or bank transfer approved by the Auctioneer.

 

Bank charges incurred on payments from overseas banks are payable by the Buyer. Cash deposits made directly into the Auctioneer’s bank account will be subject to a surcharge of 1.5%.

 

5. Descriptions, Condition & Non-Reliance

All lots are sold as seen with all faults, imperfections, and errors of description.

Descriptions, images, and reports are statements of opinion only and shall not be relied upon as statements of fact.

Catalogue descriptions are provided for identification purposes only and do not form part of the contract of sale.

No employee or representative of the Auctioneer has authority to make any representation or warranty.

The Buyer expressly acknowledges that they have satisfied themselves as to all matters relating to any lot prior to bidding.

 

Condition Information

Catalogue descriptions do not include full condition details.

No representation or warranty is made as to the condition of any lot unless expressly confirmed in writing.

The Auctioneer shall not be obliged to provide a condition report.

It is the Buyer’s sole responsibility to request such information and satisfy themselves as to the condition, completeness, and suitability of any lot prior to bidding.

The Buyer acknowledges that they have not relied on the absence of condition information.

 

Images

Images form part of the lot listing and are provided for guidance only.

The Buyer is deemed to have carefully inspected all images and satisfied themselves as to the condition of the lot.

Images may not accurately reflect the condition, colour, or detail of a lot.

The absence of any reference to defects shall not imply that such defects do not exist.

 

6. Fine Art – Attribution & Description

All attributions are statements of opinion and are not representations of fact.

Artist Name – in our opinion, a work by that artist.

Attributed to – in our opinion, probably a work by that artist.

Circle of – in our opinion, a work of the period of the artist.

After – in our opinion, a later copy of a known work.

Manner of – in our opinion, a work in the style of the artist.

Bearing a signature – no representation is made as to authenticity.

Indistinctly signed – no representation is made as to the artist.

All works are sold as decorative items unless expressly stated otherwise.

The Auctioneer will not rescind the sale of any picture or work of art except as expressly provided within these Conditions.

All sizes are approximate and exclude frames and mounts unless stated.

 

7. Jewellery & Gemstones

The Auctioneer is not a gemmologist and does not laboratory test gemstones.

Identification is based solely on the use of a handheld gem tester and visual inspection and is not definitive.

Stones may be natural, synthetic, or treated.

Gemstones may have been treated for colour or clarity.

Diamond and gemstone weights are approximate.

No refund shall be given on the basis that a gemstone is later found to be synthetic or treated.

 

8. Inspection & Due Diligence

Buyers must inspect or request further information prior to bidding.

All descriptions are subject to announcements made prior to sale.

Any person attending a viewing, preview, or collection shall be responsible for any loss or damage caused by them.

 

9. Claims

Claims must be received within 7 days of the auction date.

Claims must include independent expert evidence from a suitably qualified professional reasonably acceptable to the Auctioneer.

Late or unsupported claims will be rejected.

 

10. Refunds

No refunds shall be given except where expressly provided within these Conditions, including Clause 11.

All lots are sold as seen and all catalogue statements are opinions only.

The Buyer is deemed to have satisfied themselves prior to bidding.

 

Deliberate Forgery

A deliberate forgery is an item which, having regard to the catalogue description, is proven to the satisfaction of the Auctioneer by expert evidence to be an imitation intended to deceive.

Refunds are limited to hammer price plus buyer’s premium.

Return is at the Buyer’s cost and risk.

 

11. Counterfeit & Illegal Goods

Where a lot is alleged to be an illegal counterfeit or infringing trademark item, the Buyer must notify the Auctioneer in writing within 14 days of the auction date and provide independent expert evidence from a suitably qualified professional reasonably acceptable to the Auctioneer.

No claim will be accepted after this period. The Auctioneer shall determine, at its sole discretion, whether such a claim is accepted. If accepted, the sale will be rescinded.

 

12. Liability

The Auctioneer makes no representation as to authenticity or condition.

The Auctioneer accepts no liability except as required by law.

Any liability shall be limited to hammer price plus buyer’s premium.

 

13. Chargebacks

Buyers must follow the Claims process before initiating any chargeback.

Failure to do so shall constitute a breach of these Terms.

 

14. Vendor Recourse

The Auctioneer may refer claims to the Vendor and shall not be liable beyond these Terms.

 

15. Data & Conduct

The Auctioneer may record communications and share information regarding defaulting bidders with auction platforms, service providers, and other auctioneers.

 

16. Storage & Abandoned Goods

Collection is required by the Wednesday following the sale.

Storage charges shall accrue from the expiry of the collection deadline.

Storage charges are £5 plus VAT per lot per day for small lots and £10 plus VAT per lot per day for larger lots including furniture.

A handling fee of £5 plus VAT per lot, or £10 plus VAT for larger lots including furniture, may be charged for late collection.

Lots not collected within 1 month shall be deemed abandoned.

Where the Auctioneer determines that the total purchase price of a lot (including buyer’s premium) is less than, or is likely to be exceeded by, the accrued or anticipated storage, handling, and associated costs, the Auctioneer may treat the lot as abandoned at an earlier time.

The Auctioneer may resell, dispose of, or otherwise deal with abandoned goods without notice and without liability.

This includes lots where shipping has been arranged or quoted but not paid for.

Proceeds shall be applied to all sums owed, with any remaining balance retained to cover administrative and associated costs.

 

17. VAT & Payments

No VAT refunds on export.

All bank and foreign transaction fees are payable by the Buyer.

 

18. Updates

The Auctioneer reserves the right to update these Terms at any time.

 

FINAL NOTICE

Auctions involve inherent risk.

By bidding, the Buyer accepts full responsibility for inspection and all risks associated with auction purchases.
