Term & conditions


1. Only persons who have identified themselves with official legitimation papers are allow access to the auction rooms.

2. The house rules of the auctioneer are valid. It is the right of the auctioneer to expel any person who is disrupting or in other ways is not following the auctioneers or his substitutes instructions.

3. The auction is in the name and account of the giver of assignment.

4. The auctioneer has the right to omit a lot or change the order of a lot.

5. The auctioneer is not liable for any faults or defects on the auctioned objects. The statements in the catalogue are not guaranteed statements according §443 BGB. Guarantee requests are solely to be directed to the respective accountant. The objects in the auction are used evtl. damaged and can be viewed before the auction. The bidder can on request ask for a condition report.

6. Any flaws on the objects can not be complained, as the auctioneer does not test the functionality of the object. This is during pre-view to test oneself.

7. Pre-bids must be made in writing on the forms available in the auction house. Not rightly completed forms might not be processed. Bids given shortly before the auction starts might also not be processed. Telephone bidders has to notify the auction house at least 24 hours before auction starts. The auction house will do its best to reach the bidders accordingly, though do not guarantee or are reliable to this.

8. The auctioneer gives the hammer to the highest bidder when after three calls there are no bids. With the hammer a purchase agreement is reached between the one who holds the highest bid and the giver of assignment. With several equal bids the auctioneer decides who holds the bid.

9. In addition to the hammer price the buyer pays a buyer’s premium for the individual item. The fee consists of 22% of the hammer price + VAT of 19% of the fee.


10. Payment of purchase is immediately to be paid in cash or by money-transfer. Credit cards are only accepted by on-line bidders, checks are not accepted.

11. The purchased objects must be collected immediately after the auction has ended. Opening hours are listed on front of catalog.

12. The purchased objects must be packed and transported by the buyer. There is no claim of right of assistance for help of transport or packing material. Shipping is solely at the risk of the buyer. Should the bought object even carefully packed, be damaged during shipping, it is solely at the risk of the buyer and the auction house has no responsibility.


13. Persons attending the pre-view and/or the auction are fully liable for any damages caused by them.

14. Ownership and responsibility of the object is immediately after hammer that of the bidder. The ownership of the object is first after full payment that of the bidder.

15. The buyer/highest bidder is bound to collect the bought object/s according the opening hours on the front page of the catalog. Should the bought objects not be collected within time, storage cost of €10,—per beginning of a month will occur. 60 days after buying date the auctioneer has the right to resale the object/s and after recalculation to release a bill of costs to the original buyer.

16. The bidder agrees to the digital storage of his dates and also agrees for the future to be acknowledged, by email or post, about upcoming new auctions and to receive auction catalogs. This acceptance may at any time be withdrawn by mail.

17. German law and the german texts and conditions are binding.

18. For commercial buyers all legal matters are to be conducted in Meerbusch and/or Neuss.

19. Should one or more of the Terms & Conditions become idle, all other § are not influenced. For an idle condition or term the nearest usable term is to be used.
