The control of the bottles will have to be done on the spot during the removal. No claim can be taken into account once the bottles have left the storage place. 

You will be charged 1€ HT per batch as management costs. The storage of the bottles is free until the 31st day after the sale. Beyond that date, storage fees of 3€ HT per lot and per month will be charged directly to you. The bottles can only be removed after payment of any storage fees. SAS Auctie's SVV (hereinafter "Auctie's" or "We") is an operator of voluntary sales of furniture at public auction governed by articles L.321-4 and following of the Commercial Code. In this capacity, Auctie's acts as the seller's agent.

The relationship between Auctie's and the purchaser (hereinafter the "Purchaser" or "You") are subject to these general conditions of sale.

Voluntary sales are subject to French law and will be made expressly in cash.

 

1. Before the sale
1.1 Indicative nature of the estimates
The estimates are provided for information only, and should in no way be analyzed as a certainty as to the fact that the property will be sold at the estimated price or within the range of the estimate.

The estimates provided by Auctie's do not constitute a guarantee, and are subject to change prior to the sale.

Any offer made within the estimate range has a reasonable chance of success.

 

1.2 Batch status
We are at your disposal to provide You with a detailed report on the status of the lots.

All goods are sold in the condition in which they are at the time of sale, notwithstanding their imperfections or defects. No claim will be admissible once the auction has been announced, the successive exhibitions and the possibility of requesting a detailed report having enabled the Purchasers to examine the condition of the objects offered for sale.

It is specified that visitors and potential Purchasers have, on simple request, the possibility of accessing a more complete examination of the objects presented.

 

1.3 Pre-sale exhibition
The exhibition preceding the sale is open to all.

Auctie's strives to display items in the most secure manner with security in mind. You agree not to manipulate the objects without the authorization of Auctie's.

Any manipulation of objects not supervised by Auctie's is at your own risk.

 

2. Auctions
Bids can be placed in person, over the phone or through a third party. The auctions will be conducted in euros.

 

2.1 Bid in person
In order to have the possibility of participating in the auction in person, a means of payment (check or credit card details) and the marital status of the buyer (personal information) domicile, must first be deposited by the potential Purchaser with from the auction room. A plate number will be given to him in return. This number will make it possible to identify the Purchaser in the event of acquisition of a lot.

Access to the sales room is free, free of charge, and does not require any pre-registration.

During the notification of the auction, the potential Buyer present in the auction room makes a gesture to the attention of the auctioneer in order to bid.

2.2 Bidding by telephone

2.3 Mandate to a third-party bidder
When You bid during the sale, You do so in your personal capacity and we can hold You solely responsible for paying the auction price as well as any tax or duty that may be payable, unless you have notified us beforehand. that you bid in the name and on behalf of a third party by providing us with a regular mandate that we will have previously registered.

 

2.4 Buy orders
In the event that You are unable to attend the sale, Auctie's offers to execute the purchase orders that You have transmitted to us prior to the sale, before, during, or after the exhibitions in writing. , in euros, and in your name

This service is free and confidential.

The lots are purchased at the best price, respecting the reserve price stipulated by the seller, and the other auctions. In the event that several purchase orders relate to identical bid amounts, the oldest order will have preference and will win the sale.

3. Sale
3.1 Terms of sale
As indicated above, the auction is governed by the legal rules and those contained in this text. 3.2 Access to lots during the sale

4.3 Payment
The Purchaser proceeds to the payment of the lot as well as the costs and taxes, in cash, immediately after the sale. Payment can be made:

In cash in euros within the limit of 1,000 (one thousand) euros for Purchasers having their tax residence in France, and within the limit of 15,000 (fifteen thousand) euros for Purchasers having their tax residence abroad, upon presentation of 'proof.

4.4 Buyer Fee
The Purchaser will pay to the order of SAS AUCTIE'S SVV, in addition to the auction price, a buyer's commission of:

20.90% excluding tax or 25% including tax for DROUOT (27% including tax for live auctions)
18.83% excluding tax or 22.6% including tax for GIEN

4.5 Default of payment
The auctioned property can only be delivered to the Purchaser when Auctie's has received the price or when any guarantee has been given to it on payment of the price by the purchaser.

In the absence of payment, after formal notice has remained unsuccessful, and in accordance with the provisions of the Commercial Code, the property is put up for sale at the request of the seller on reiteration of the auction.

Failing this, the sale will be canceled as of right.

Charges may be applied against the defaulting buyer.

 

4.6 Collection of purchases
Auctie's is liable to the buyer for the delivery of the property it has sold.

Purchases cannot be collected until Auctie's has received full payment. All prizes may be removed during or after the session on presentation of the authorization to issue the accounting department of SAS Auctie's, or failing that, a slip with the mention "settled" or "paid".

Purchasers will be able to obtain all information concerning the delivery and shipping of their purchases at the end of the sale. Auctie's stores the goods free of charge at the end of the sale for a period of 15 (fifteen) days. From the 16th day, storage costs of €3 excl. VAT/day will be invoiced, without prior information, the Purchaser having to make every effort to recover his goods at the end of each sale.

 

4.7 Transfer of risk
From the auction, the goods are placed under the full responsibility of the Purchaser: the blow of the hammer transfers ownership of the property and the risks to the Purchaser.

The Purchaser cannot hold Auctie's responsible in the event of loss of degradation, or theft of the lot after the auction.

 

4.8 VAT
All lots will be sold on a margin basis. Any invoiced VAT will be reimbursed to Purchasers who are not residents of the European Union provided that they make a written request to the accounting department within 3 months after the sale, and on presentation of copy 3 of the customs document. export (DAU) on which SAS AUCTIE'S SVV must appear as sender and the Purchaser as recipient.

The export must take place within the legal deadlines.

 

4.9 Right of first refusal

5. Miscellaneous
5.1 Fight against money laundering
As an intermediary in the sale of works of art, Auctie's is subject to the obligations to combat money laundering and the financing of terrorism pursuant to article L-561-2 of the Monetary and Financial Code.

 

5.2 Intellectual Property
Reproduction rights to Auctie's catalogs are the exclusive property of Auctie's. Any reproduction or use of the catalogs without the express and prior authorization of Auctie's is prohibited, under penalty of legal proceedings.

 

5.3 Applicable law and jurisdiction
These general conditions are subject to French law.

Any dispute relating to their existence, their validity, their enforceability and their execution will be subject to the exclusive jurisdiction of the courts of Paris (France), unless otherwise provided.
